An affidavit is a written statement for use as evidence in court proceedings. When witnessing an affidavit, a JP must hear the deponent swear an oath or make an affirmation.

If a JP witnesses the affidavit of a person who does not speak English, they must use an interpreter. Both the deponent and interpreter must swear a separate affidavit. Further information is available in section 2.4 of the JP handbook.
